Definitions and Statement

I/we warrant and confirm that the information given herein is true and correct and I/we understand clearly that it is being used to determine my/our credit responsibility. Essex Lease Financial Corporation (“ELFC”) is authorized to obtain any information required relative to this application from any necessary

sources, and each such source is hereby authorized to provide ELFC with such information. ELFC is authorized to disclose, in response to direct enquiries from any other lenders or credit bureaus, such information on my account as considered appropriate, and I/we agree to indemnify and save ELFC harmless from any claims in damages or otherwise arising from such disclosure. ELFC is authorized to retain the application whether approved or not.

Politically Exposed Person is an individual who holds or has ever held one of the following offices or positions in or on behalf of Canada or a foreign country/state; a head of state or government, a member of the executive council of government or member of a legislature, a deputy minster (or equivalent), an ambassador or ambassador’s attaché or counselor, a military general (or higher rank), a president of a state owned company or bank, a head of government agency, a judge, a leader or president of apolitical party in a legislature, the mayor of a Canadian city or town. Domestic PEPs cease to be PEPs within 5 years of leaving office.

Head of an International Organization is an individual who is either: 1) the leading officer of an international organization established by the government of states (such as the United Nations); or 2) the head of an institution established by an international organization (such as the World Health Organization). HIOs cease to be HIOs upon leaving office.

Family includes parent, spouse or common-law partner, child, sibling, mother-in-law or father-in-law. Close Associate is any individual that is reasonably known to be a close associate of a PEP/HIO.  

I/we have been informed by ELFC or its representative that the personal information collected is collected, used and disclosed for the following purposes: (a) understanding my needs and determining the suitability of particular products or services for customers, including creating and maintaining credit scoring models; (b) determining my/our eligibility for products and services, including the identification of any guarantors, assessing applications and conducting initial and periodic credit checks; (c) providing me/us with relevant products, service or information, including information about promotions or other opportunities by whatever means (including direct marketing) offered by ELFC or its affiliates; (d) maintaining an on-going relationship with me/us; (e) where circumstances require, collecting amounts outstanding from me/us and those that have provided security for me/us; (f) protecting against fraud; or (g) meeting legal and regulatory requirements, including tax or other reporting requirements.

I/we understand that ELFC’s collection, use and disclosure of the customer personal information shall be done in accordance with its Privacy Policy and applicable laws. Electronic storage of personal information is done by ELFC through highly secure service provider(s) in Canada or the USA. All paper based information and files are stored in a secure, locked facility.
